Austin watershed regulations: which classification and zone your lot is in
Two questions, not one
People ask "what are the watershed rules for my lot" as though there is one answer. There are two, and you need both.
- Which watershed classification? Urban, suburban, water supply suburban or water supply rural. This is fixed by which creek your land drains to, and it is listed by name in §25-8-2(D). It drives your impervious cover limit.
- Which zone within your site? Critical water quality zone, water quality transition zone, or uplands. This depends on how close you are to a waterway and how big that waterway's drainage area is. It drives whether you can build on a given part of the lot at all.
Neither answer gives you the other. A lot in a permissive urban watershed can still have a strip along the back that cannot be built on, and a lot in a restrictive water supply rural watershed may be entirely uplands.
On top of both sits the Barton Springs Zone, which is not a classification but an overlay with its own requirements.

From §25-8-2(D). The suburban row is not an omission — the code defines suburban residually. The impervious cover consequences of each classification are on the impervious cover page.
The three zones, and how a waterway earns one
Zones are driven by waterways, and a waterway's size is measured by drainage area — not by how much water you can see in it. §25-8-91 sets the thresholds, and they apply in every watershed except urban:
- Minor — drainage area at least 64 acres, not more than 320;
- Intermediate — more than 320 acres, not more than 640;
- Major — more than 640 acres.
That 64-acre floor is worth remembering. A gully that runs three days a year can still be a regulated minor waterway if enough land drains into it.
From those classifications come the three zones:
- Critical water quality zone (CWQZ) — closest to the waterway. Development is prohibited here except for a short list of things.
- Water quality transition zone (WQTZ) — the band immediately outside the CWQZ. It exists only in water supply rural, water supply suburban and the Barton Springs Zone, and not along Lake Austin, Lake Travis or Lady Bird Lake. Its width is 100 ft for a minor waterway, 200 ft for intermediate and 300 ft for major.
- Uplands — §25-8-94 defines it by subtraction: all land and waters not in a CWQZ or a WQTZ. This is where the impervious cover percentages you have probably been quoted actually apply.
The Edwards Aquifer zones are a separate overlay again
Two more terms that sit across the classifications rather than inside them:
- Edwards Aquifer recharge zone — all land over the aquifer that recharges it, determined by the surface exposure of the geologic units that make up the Edwards, including areas overlain with quaternary terrace deposits.
- Edwards Aquifer contributing zone — land generally to the west and upstream of the recharge zone that drains into it.
These matter because several of the strictest rules key off them rather than off the watershed classification — including the Save Our Springs impervious cover limits and the Barton Springs Zone transition zone prohibition.
And a practical trap. §25-8-2(C) provides that for property within 1,500 feet of a recharge zone boundary, the director may require a certified report from a geologist or hydrologist verifying where the boundary actually runs. Being near the line, not just over it, can add a specialist report to your programme.
What we do before anything else
We establish the classification and the zones before sketching, because they are the constraints that cannot be designed around. Floor area you can work with. A critical water quality zone across the back third of the lot you cannot.
The one that surprises people most often is the drainage-area rule. Clients look at a dry ditch and assume it is nothing. Sixty-four acres of upstream drainage makes it a minor waterway, and in a suburban watershed that is a 100-foot buffer from the centreline.
§25-8-2(B) puts boundary determination with the director, so where a boundary is genuinely ambiguous the answer is a conversation with Watershed Protection early rather than an assumption carried through design.
